The Florence Project is disappointed with the August 14th ruling by the Arizona Supreme Court that HCR 2060 (Prop 314) does not violate Arizona’s single-subject rule, a ruling that allows Prop 314 to be on November’s ballot.
If it becomes law, Prop 314 would criminalize migration, empower state law enforcement to engage in racial profiling, and allow people to be arrested, prosecuted, and deported without ever seeing an immigration judge, harkening directly back to the SB 1070 era in Arizona.
In response to the ruling, Legal Director Laura St. John said: “Much like SB 1070, this ballot measure is not only unconstitutional under state and federal level, but also a disastrous set of policies for Arizona that will cause immeasurable harm by sowing fear and inviting racial profiling. Simply put, it is bad for migrants, bad for our communities, and bad for Arizona. It will also be economically disastrous as an unfunded mandate that will cost millions of dollars in legal challenges, not to mention implementation costs. We hope the voters of Arizona will make the right choice in November and reject this illegal and immoral proposition that fails to solve the very real challenges we face at our southern border.”
